Last week, Bryan McCarthy, the 32-year-old operator of ChannelSurfing.net, was arrested on charges of criminal copyright infringement. This arrest has once again raised questions about the seizure of domains operated by those that are accused, but not convicted, of copyright infringement related crimes. Critics ranging from bloggers to individual rights advocates to Senators have rightfully questioned the constitutionality of these seizures.

The most serious constitutional issues with the domain seizures arise because the Government does not provide any notice to the domain owners prior to seizing them. One moment, their normal site is up at their web address, the next moment, all that is up at their web address is a DHS/ICE seal.

Without knowing what they have been accused of or having the opportunity to defend their site, the Government has repurposed the owners’ private property.

channelsurfingIn order to seize the domain names without notice to the owners, the Government uses a procedure that permits it to bring an action directly against a piece of property used in the commission of a crime –in this case the domain name– rather than the owner. This type of action (called an “In Rem” forfeiture) is not new. In the past, the Government has used In Rem actions for purposes such as an action against an automobile used to transport bootleg whiskey.

An In Rem action does not necessarily require the Government to wait until a court hears both sides and rules that the property has been used for illegal purposes and is subject to forfeiture. Instead, in many cases, the law is written so that all the Government has to do is to sign an affidavit that demonstrates probable cause for the forfeiture, which is signed by a magistrate judge and the Government can seize the property. Truth comes out: 2009 H1N1 flu pandemic ‘deaths’ of children were actually caused by MRSA

(NaturalNews) Remember two years ago when every news show featured hysterical reports about the so-called H1N1 pandemic and how the supposed killer flu was striking down healthy kids? True, many previously healthy children became critically ill, developing severe pneumonia and respiratory failure. And some tragically died after being diagnosed with H1N1. But was that really the accurate explanation of what caused their death?

According to the largest nationwide investigation to date of the flu in children who became critically ill, scientists from Children’s Hospital Boston have found another reason to explain the severity of the youngsters illness. It turns out that it most likely wasn’t H1N1 alone that caused healthy children to become so ill many died.

Instead, these kids were unknowingly infected with something else. That additional infection, the superbug known as methicillin-resistant Staphylococcus aureus (MRSA), spiked the risk for flu-related deaths 8-fold in children who were otherwise believed to be totally healthy before they became ill.

Almost all of these children who were found to be infected with the superbug were immediately treated with vancomycin, considered to be best treatment for MRSA. Yet they died despite being administered this powerful antibiotic and their deaths were blamed on the flu. But the new research suggests it was the MRSA that played a huge role in killing these children. Continue reading

Health department tyrants raid local ‘farm to fork’ picnic dinner, orders all food to be destroyed with bleach

(NaturalNews) It is the latest case of extreme government food tyranny, and one that is sure to have you reeling in anger and disgust. Health department officials recently conducted a raid of Quail Hollow Farm, an organic community supported agriculture (CSA) farm in southern Nevada, during its special “farm to fork” picnic dinner put on for guests — and the agent who arrived on the scene ordered that all the fresh, local produce and pasture-based meat that was intended for the meal be destroyed with bleach.

For about five years now, Quail Hollow Farm has been growing organic produce and raising healthy, pasture-based animals which it provides to members as part of a CSA program. And it recently held its first annual “Farm to Fork Dinner Event,” which offered guests an opportunity to tour the farm, meet those responsible for growing and raising the food, and of course partake in sharing a meal composed of the delicious bounty with others.

But when the Southern Nevada Health District (SNHD) got word of the event and decided to get involved, this simple gathering of friends and neighbors around a giant, family-style picnic table quickly became a convenient target for the heavy hand of an out-of-control government agency. And Monte and Laura Bledsoe, the owners and operators of Quail Hollow Farm, were unprepared for what would happen next.

SNHD official Mary Oaks raids picnic without cause or warrant, orders destruction of dinner food
Laura Bledsoe explains in a letter to her guests written after the fact that two days prior to the event, SNHD contacted the farm to say that, because the picnic was technically a “public” event, the couple would have to obtain a “special use permit,” or else face a very steep fine. Not wanting to risk having the event disrupted, the Bledsoes agreed to jump through all the demanded legal hoops even though their gathering was really just a backyard picnic. Continue reading

Satire: Organized Crime

IRS illegal?  Yes

IRS a Service?  NO

When dark deeds unfold, point the finger in this direction.

-Tony Cartalucci

This is your real government; they transcend elected administrations, they permeate every political party, and they are responsible for nearly every aspect of the average American and European’s way of life. When the “left” is carrying the torch for two “Neo-Con” wars, starting yet another based on the same lies, peddled by the same media outlets that told of Iraqi WMD’s, the world has no choice, beyond profound cognitive dissonance, but to realize something is wrong.

What’s wrong is a system completely controlled by a corporate-financier oligarchy with financial, media, and industrial empires that span the globe. If we do not change the fact that we are helplessly dependent on these corporations that regulate every aspect of our nation politically, and every aspect of our lives personally, nothing else will ever change.

The following list, however extensive, is by far not all-inclusive. However after these examples, a pattern should become self-evident with the same names and corporations being listed again and again. It should be self-evident to readers of how dangerously pervasive these corporations have become in our daily lives. Finally, it should be self-evident as to how necessary it is to excise these corporations from our lives, our communities, and ultimately our nations, with the utmost expediency.

“if this fucked up government really cared about your heath, they would ban ciggarettes”  -Joe Rogan

Do you take your daily multi, or at least make it an intention? That option might become a lot more complicated in the near future.

The FDA, which regulates foods and drugs in the US, has turned its focus on nutritional supplements — and its proposed criteria will leave very few supplements standing.

Here’s what could go down:

  1. Under these new guidelines, Vitamin A, B complex, C, and D, as well as CoQ 10, would be outlawed.
  2. The FDA will require that supplement manufacturers fund prohibitively expensive studies using doses multiplied by a “safety factor” of as high as 2,000 times the recommended dose. For instance, the FDA is proposing that two species of animals, rodents and young dogs, will be forced to ingest 2.4 million milligrams of fish oil per day, for 90 days. Humans take 2,400 milligrams daily — and we weigh 10 times as much as small dogs. In addition to these inhumane practices, this requirement will destroy most supplement companies (except those secretly owned by pharmaceutical manufacturers).
  3. Supplements can only include ingredients found in the “typical food supply.” And what exactly does that mean to the FDA? Does echinacea qualify as being in the typical food supply? (I doubt it, since deep fried echinacea blossoms are not on your local Applebee’s menu.)
  4. The FDA will only approve supplement ingredients that are at the same levels that it uses for synthetic food additives and preservatives, which is in violation of the 1994 law, the Dietary Supplement Health and Education Act (DSHEA), which categorizes supplements as foods, not additives.
  5. The FDA is treating supplement ingredients under the same exacting scrutiny as it does with known cancer-causing chemicals like aspartame, MSG, and sodium nitrate — demanding that the supplements be reduced to “inert” levels of concentration that will render them ineffective to consumers.
  6. Each ingredient, as well as the supplement itself, will be required to undergo a New Dietary Ingredient Notification (NDIN) process — even if the same ingredient is used by other companies. This process takes 75 days at a bare minimum. And as of yet, 83% of NDINs have been rejected by the FDA. And by the way, “new” refers to products that have been in use for up to 17 years.
